1. Who we are

FiloApp is operated by Bitharmony Limited, a company registered in England and Wales, company number 17129740, with its registered office at Greenacres, Bittams Lane, Chertsey, Surrey, KT16 9QX.

You can contact us at contact@filoapp.co.uk. In these terms, “we”, “us” and “our” mean Bitharmony Limited, and “you” means the person using FiloApp.

2. These terms

These Terms & Conditions govern your use of FiloApp. By creating an account or using FiloApp, you agree to these terms. If you do not agree, you must not use the app.

Our Privacy Policy explains how we handle your personal data and forms part of your agreement with us.

3. Eligibility

You must be at least 18 years old to use FiloApp. You must provide accurate information when registering and keep it up to date. You may only use FiloApp for your own business, or where you have authority to manage records on behalf of another person or business.

4. What FiloApp does

FiloApp provides software tools to help you:

  • keep digital business records;
  • manage income, expenses and mileage;
  • connect to HMRC and retrieve information from HMRC; and
  • prepare and submit Making Tax Digital (MTD) information where supported.

Where you authorise it, FiloApp accesses HMRC data and submits information to HMRC through HMRC’s approved APIs.

FiloApp is designed to support Making Tax Digital for Income Tax. HMRC recognition means that the software meets HMRC’s technical requirements; it does not mean that HMRC endorses FiloApp or checks the accuracy of information prepared or submitted using it.

5. Not advice

FiloApp is not an accounting firm, tax adviser, financial adviser or legal adviser, and nothing in the app constitutes tax, accounting, financial or legal advice. Features such as AI-assisted transaction categorisation, tax estimates and summaries are tools to assist you, not professional advice. If you are unsure about your tax position, you should consult a qualified professional.

6. Your responsibilities

You are responsible for keeping your records accurate, complete and up to date, and for reviewing all data in FiloApp — including imported data, uploaded bank statement transactions, AI-categorised transactions, mileage records and tax summaries — before relying on it or submitting it to HMRC.

You are also responsible for keeping your login details secure, for all activity that takes place under your account, and for complying with your own tax obligations, including filing and payment deadlines.

7. HMRC submissions

Where FiloApp allows you to submit MTD information to HMRC, you remain responsible for checking that all information is correct and complete before submission. A submission made through FiloApp is your submission, made on your authority.

We are not responsible for penalties, interest, losses or other issues caused by incorrect, incomplete or late information provided or approved by you, or by your failure to meet a deadline.

You should keep confirmation receipts, submission references or records of successful submissions where provided.

8. Bank statement uploads, imports and third-party services

FiloApp lets you import records from CSV or Excel files and upload bank statements so transaction data can be read into your records. FiloApp does not connect to your bank account or ask for your online banking credentials.

Payments and subscriptions are processed by third parties such as Apple, Google and our payment providers, under their own terms.

Imported data may be incomplete, duplicated or incorrect. You must review imported data before relying on it or using it for HMRC submissions.

9. Subscriptions, billing and refunds

FiloApp may offer monthly or annual subscriptions, purchased through the Apple App Store or Google Play. Prices are shown in the app before you subscribe. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period.

You can manage or cancel your subscription at any time in your App Store or Google Play account settings. Cancelling stops future renewals; access normally continues until the end of the period you have paid for.

Refunds for purchases made through an app store are handled by the relevant store under its policies. Nothing in these terms affects your statutory rights as a consumer, including any rights you have where digital content is faulty or not as described.

10. Beta features

During beta testing, FiloApp or specific features may be provided for testing and feedback. Beta features may contain errors, interruptions or incomplete functionality and may change or be withdrawn at any time. You should not rely on beta functionality as your only record-keeping method, and you should keep independent copies of important records.

11. Acceptable use

You must not:

  • use FiloApp to break the law, commit or facilitate fraud, or submit information you know to be false;
  • infringe anyone else’s rights;
  • attempt to gain unauthorised access to FiloApp or its systems, or interfere with its operation;
  • introduce malicious code; or
  • use automated means to scrape or copy the service.

12. Intellectual property

FiloApp, including its software, design, branding, content and features, belongs to Bitharmony Limited or its licensors. We grant you a personal, non-exclusive, non-transferable licence to use the app for its intended purpose. You must not copy, modify, reverse engineer, resell or sublicense the app except where the law allows. Your records remain yours.

13. Availability and changes

We may update, improve, suspend or remove parts of FiloApp from time to time, including to comply with changes to HMRC’s APIs and requirements. We will try to keep the app available, but we do not guarantee that it will always be uninterrupted or error-free, and HMRC’s own services may be unavailable from time to time for reasons outside our control.

14. Limitation of liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded or limited under English law, and nothing affects your statutory rights as a consumer.

Subject to that, FiloApp is provided without warranties that it will be error-free, uninterrupted or suitable for every user’s circumstances, and we are not responsible for indirect losses, loss of profit, loss of business, loss of data, tax penalties or losses caused by incorrect information entered, imported, approved or submitted by you.

15. Suspension and termination

We may suspend or terminate your access if you seriously or repeatedly breach these terms, provide false information, attempt fraud, or use the service unlawfully. Where reasonable, we will give you notice and an opportunity to export your records first.

You can stop using FiloApp and close your account at any time. Closing your account does not entitle you to a refund of any subscription period already paid for, except where required by law or the relevant app store’s policies.

16. Your data and record keeping

We process personal data in accordance with our Privacy Policy. FiloApp allows you to export your records so that you can keep a copy or move your data elsewhere.

HMRC requires self-employed individuals to retain business records for at least 5 years after the relevant 31 January submission deadline. Before closing your account, you should export and retain your records — once your account is deleted, we may no longer be able to recover them for you.

17. Changes to these terms

We may update these Terms & Conditions from time to time, for example to reflect new features, legal requirements or changes to HMRC’s rules. If changes are significant, we will notify you in the app and may ask you to accept the updated terms before continuing to use FiloApp. The latest version will always be available in the app and on our website.

18. General

If any part of these terms is found to be invalid or unenforceable, the rest will continue to apply. If we do not enforce a right under these terms, that is not a waiver of it. These terms, together with the Privacy Policy, are the entire agreement between you and us about FiloApp. You may not transfer your rights under these terms to anyone else without our consent.

19. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales will have jurisdiction over disputes relating to them. If you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
